Man Avoids Prison After Violating House Detention

Indianapolis criminal defense attorney Sean Hessler recently assisted a 54-year-old man, who was already serving a home detention sentence, when a domestic dispute and a subsequent battery charge, put his freedom in serious jeopardy. After a quarrel with his significant other, the man was charged with domestic battery, which is a misdemeanor and punishable by up to a year in jail in addition to the six years he’d face, if convicted of violating the terms of his home detention.

Attorney Hessler proceeded to handle the domestic dispute case first and after highlighting the inconsistencies with the witness statements and the police report, the battery offense was dismissed. Unfortunately, his client still needed to contend with a probation violation hearing, but attorney Hessler argued that since his client was no longer charged with battery, the violation should also be dismissed. In the end, the court agreed and due to Hessler’s ability to articulate his client’s situation in a very complicated situation, the man could resume his sentence rather than serving a long prison sentence.
