Out of State OVWI Resolved Quickly

We represented a 37-year-old Indiana visitor after she was charged with OVWI. Since she lived out of state, the client wanted the case over quickly with minimal impact on her life so she contacted an experienced criminal defense attorney. We worked out a deal that allowed her to participate in diversionary classes in her home state, sentenced to time served, and only had to serve a 60-day license suspension, which was already served by the time the case concluded.

Probation for Marijuana OVWI

Indianapolis criminal defense attorney Sean Hessler represented a 27-year-old after he was stopped at a sobriety checkpoint. The officers smelled marijuana and the young man was charged with an OVWI involving marijuana as well as marijuana possession.

This could have resulted in jail time, a suspended license, and a drug conviction. However, attorney Sean Hessler worked out a favorable agreement for one year of probation and saw the possession charge dismissed and let him keep his license.

Welfare Fraud Reduced for No Jail

A 54-year-old construction worker recently found himself in a difficult spot when he was charged with welfare fraud. Apparently, he was sent a few extra checks and didn’t report the overpayment. When asked by the Indiana Department of Revenue, he admitted to the situation and agreed to make restitution.

Making a statement without an attorney turned out to be a mistake because the Department of Revenue referred the matter to the prosecutor, who decided to file criminal charges. This exposed him to felony charges and possible time in custody, so he needed the help of an Indiana criminal lawyer. After attorney Hessler got involved, he negotiated to reduce the charge for no jail time and let him maintain his repayment plan.

No Negative Consequences in Juvenile Sex Crime Case

We recently represented a 16-year-old accused of recording a sexual encounter with another minor and sharing it. This led to felony child exploitation charges and could have ended with him being held in juvenile detention and mandatory sex offender registration despite the young man’s age. He reached out to Hessler Law to get help from an Indianapolis criminal lawyer with juvenile defense experience.

We evaluated the evidence and there was some dispute regarding who was actually the person in the video. By pointing out the weaknesses in the case and submitting our client to a mental health evaluation, Sean Hessler resolved the case with an informal adjustment. As a result, the juvenile saw no long-term consequences and could move on with his life.

Felony Charges Dismissed in Shooting Case

We recently helped a 19-year-old college student, charged with a third-degree felony for aggravated assault when he was accused of shooting someone. Faced with the possibility of spending between three and 16 years in prison, Defense lawyer Hessler began reviewing the facts in this very serious case.

During an in-depth investigation, it became clear that there were numerous inconsistencies in the timing of the incident and the reliability of the victim’s ID. In addition, we made the prosecution aware of another individual who confessed to the act in question. After several pre-trial hearings to dispute the evidence and admit the confession, the prosecution ultimately dismissed the charges. In the end, a trial was unnecessary and we gave our client the chance to move on with his life.
