Recently, a 29-year-old man was approached by police near a schoolyard after apparently having too much to drink. While he was charged with public intoxication, the officers also found a single prescription pill and a small amount of marijuana in his possession. Because the man was found near a school, the officers decided to charge him with felony possession of a controlled substance and felony possession of THC, which created a new level of legal trouble with a possible penalty of five years in prison. Desperate to avoid such a devastating outcome, the man came to Indianapolis defense attorney Sean Hessler to review his available options.

After consulting with attorney Hessler, it was apparent the officers improperly charged his client. Criminal lawyer Hessler discussed the situation with the prosecution and by leveraging the fact that there were mitigating factors involved and that his client should have been charged with lesser, misdemeanor offenses, he effectively achieved the complete dismissal of both felony drug charges. The man ultimately agreed to plead to the original misdemeanor of public intoxication and was pleased to learn that once he completes 180 days of probation, he could move on with his life, without further concern.
