Dealing with difficult family situations is something everyone can relate to, but if criminal accusations are ever made against you, the impact of these claims can significantly impact your life. If this happens, it is important to discuss your circumstances with a knowledgeable defense attorney. Recently, a young couple faced a dreadful situation after they were accused of the purposeful medical neglect of their own child for allegedly removing their premature baby’s feeding tube to receive unnecessary medical care. This led the Indiana Department of Child Services to file a Child in Need of Services (CHINS) case against the couple and had the child placed in a relative’s care pending a resolution, which required the parents to be investigated and go through counseling.

To protect their family and clear their names, the couple reached out to Indianapolis child custody lawyer Sean Hessler, who saw this CHINS case as superfluous and initiated an independent investigation on his clients’ behalf. After speaking with the witnesses, medical professionals, and social workers involved, it became clear that the child in question could remove the feeding tube on his own. Once attorney Hessler presented this evidence and vigorously argued the state could not prove the allegations made against his clients, the CHINS case was dismissed and the child was returned to his loving and caring parents.

The outcome of an individual case depends on a variety of factors unique to that case. Case results do not guarantee or predict a similar result in any similar or future case.
